By accessing or using MyFedPath (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the platform. Your continued use after changes constitutes acceptance of modified terms.

2. User Requirements & Eligibility

By using MyFedPath, you represent and warrant that:

• You are at least 18 years old
• You have legal capacity to enter binding contracts
• You are using the service for lawful purposes only
• You are accessing the service for personal retirement planning
• All information you provide is accurate and current
• You will notify us of any unauthorized use of your account

3. No Financial, Legal, or Tax Advice

CRITICAL NOTICE: MyFedPath does NOT provide financial, legal, or tax advice. All tools, calculators, estimates, and projections are for EDUCATIONAL PURPOSES ONLY.

• All calculations are ESTIMATES based on current rules and formulas
• Federal retirement rules can change without notice
• Tax implications vary by individual circumstances
• State-specific rules are not considered
• Always consult qualified professionals before making financial decisions
• Verify all information with official government sources
• Past performance data does not guarantee future results

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, whether express or implied. We specifically disclaim ALL warranties including:

USE OF OUR CALCULATORS AND TOOLS IS AT YOUR SOLE RISK.

5. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL MYFEDPATH, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:

Maximum Liability: Our total liability is limited to the amount you paid for the service in the past 12 months.

Excluded Damages (We are NEVER liable for):

• Indirect, incidental, special, or consequential damages
• Lost profits, savings, or expected retirement benefits
• Loss of data (including encrypted stored data)
• Decisions made based on our tools or calculations
• Errors in retirement calculations or projections
• Financial losses of any kind
• Emotional distress or mental anguish
• Lost opportunity costs
• Tax consequences of retirement decisions
• Government benefit miscalculations
• Missed deadlines or filing dates
• Any damages exceeding your subscription fee

THIS LIMITATION APPLIES EVEN IF:

• We've been advised of the possibility of such damages
• Our remedies fail their essential purpose
• The damages result from our negligence
• The damages result from service interruptions or data loss

6. Indemnification

You agree to defend, indemnify, and hold harmless MyFedPath, its owners, employees, and affiliates from ANY and ALL claims, damages, losses, costs, and expenses (including attorney fees) arising from:

• Your use or misuse of our service
• Your violation of these terms
• Decisions you make based on our calculations
• Content you upload (including custom background images)
• Your violation of any laws or third-party rights
• Claims by your family members, beneficiaries, or estate
• Tax consequences of your retirement decisions
• Unauthorized access to your account due to your negligence
• Your professional use of our personal-use-only tools
• Any claim that your use harmed a third party

7. License Grant and Commercial Use Restrictions

a. Personal Use License: Your subscription grants you a limited, non-exclusive, non-transferable license for personal, individual, non-commercial retirement planning only.

b. Prohibited Commercial Uses: You may NOT use MyFedPath for:

• Conducting paid retirement seminars or workshops
• Providing professional financial advice to clients
• Any professional capacity where you receive compensation
• Creating educational materials for sale
• Demonstrating tools in commercial settings
• White-labeling or presenting our tools as your own
• Reselling access or creating derivative works
• Screenshots or recordings for commercial purposes

c. Enforcement: Violations will result in:

• Immediate account termination without refund
• Legal action for damages and injunctive relief
• Liquidated damages of $5,000 per violation
• Recovery of all attorney fees and costs
• Permanent ban from all services

8. Intellectual Property Rights

• Federal retirement formulas are public domain
• MyFedPath's implementation, interface, and optimization are proprietary
• You may not reverse-engineer, decompile, or copy our code
• Screenshots of premium features require written permission for public use
• You grant us unlimited license to any feedback you provide
• All reports and outputs contain watermarks that must not be removed

9. Subscription Terms

Tiers and Pricing:

• Free Tier: Basic access with advertisements
• Pro Tier: $2.99/month or $29.99/year (reduced ads)
• Premium Tier: $4.99/month or $49.99/year (ads only on TSP Watch and TSP Watch Directory pages)
• Professional/Instructor License: Contact support@myfedpath.com for pricing

Billing Terms:

• Subscriptions auto-renew unless cancelled
• Cancel anytime; access continues until period ends
• No partial refunds for cancelled subscriptions
• Price changes effective at next renewal with 30 days notice
• Downgrades effective at current period end
• Upgrades charged immediately (prorated)
• Failed payments may result in immediate service suspension

Refund Policy:

• Web purchases: Within 3 days if service barely used
• All refunds reviewed with usage logs to prevent abuse
• Refund abuse will result in account termination and ban
• No refunds after 3 days for any reason
• Subscription renewal refunds only for proven technical errors

Account Sharing: Each subscription is individual. Sharing credentials is strictly prohibited and will result in immediate termination without refund.

Subscription Management Responsibility:

• YOUR SOLE RESPONSIBILITY: You are solely responsible for managing your subscription, including cancellation before renewal dates
• Auto-Renewal Notice: All subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• No Refunds for Forgotten Cancellations: We will NOT provide refunds if you forget to cancel your subscription
• Calendar Reminders: We recommend setting personal calendar reminders for renewal dates
• Account Access Required: You must maintain access to your account email to manage subscriptions
• No Exceptions: "I forgot" or "I didn't use it" are NOT valid reasons for refunds
• Subscription Status: You can check your subscription status anytime in your account profile
• Cancellation Confirmation: Always verify you receive a cancellation confirmation; if not, contact support immediately
• Payment Method Updates: You are responsible for keeping payment methods current; expired cards may still be charged through card updater services
• Long-Term Subscriptions: Annual subscriptions are especially your responsibility to track and cancel if unwanted
• Third-Party Processors: Subscription management through app stores (Apple, Google) follows their policies, not ours
• Dispute Time Limits: Subscription disputes must be raised within 30 days of the charge
• By subscribing, you explicitly acknowledge that forgetting to cancel is not grounds for a refund

10. Advertising and Third-Party Content

• Free and Pro tiers include advertisements
• Premium tier includes ads only on TSP Watch and TSP Watch Directory pages
• We do not control ad content or targeting
• Third-party advertisers may use cookies and tracking
• We are not responsible for advertiser content or practices
• Ad blockers may interfere with service functionality
• You agree to receive ads as part of free/reduced-price tiers
• Clicking ads may subject you to third-party terms and tracking

11. Dispute Resolution & Arbitration

Binding Arbitration: Any disputes will be resolved through binding arbitration under JAMS rules, not in court.

Class Action Waiver: You WAIVE all rights to:

• Bring or participate in class action lawsuits
• Join claims with other users
• Bring representative actions
• Jury trials

Arbitration Process:

• Must attempt good faith resolution first (30 days)
• Arbitration costs split per JAMS rules
• Arbitration conducted virtually when possible
• English language only

Exceptions: Small claims court actions and injunctive relief for intellectual property violations.

12. Account Management

• We may suspend accounts for payment failures
• We may terminate accounts for terms violations
• We may refuse service for any lawful reason
• You're responsible for account security
• Report unauthorized access immediately to support@myfedpath.com
• Multiple account creation is prohibited
• Account transfers are not permitted

13. Modifications to Service

We reserve the right to:

• Modify or discontinue features without notice
• Change calculation methodologies
• Update these terms with notice via email or website
• Delete user content that violates terms
• Implement usage limits or throttling
• Change subscription tiers or benefits
• Introduce new restrictions

14. External Links & Third Parties

• We're not responsible for third-party content
• Links to government sites are for convenience only
• Third-party terms apply to their services
• We don't endorse external sites
• External sites may have different privacy practices

15. Force Majeure

We're not liable for failures beyond our control including:

• Government actions or regulation changes
• Natural disasters or acts of God
• Internet or infrastructure outages
• Third-party service failures (Firebase, Stripe, etc.)
• Cyber attacks or security breaches
• Pandemics or emergencies
• Labor disputes
• Power outages

16. Prohibited Conduct

You may not:

• Use automated systems, bots, or scrapers
• Attempt to gain unauthorized access
• Interfere with service operation
• Upload malicious code or viruses
• Harass other users or staff
• Misrepresent your identity or affiliation
• Use the service for illegal purposes
• Circumvent subscription requirements

17. Severability

If any provision is unenforceable, the remainder stays valid. Unenforceable provisions will be modified minimally to become enforceable.

18. Entire Agreement

These Terms and Privacy Policy constitute the entire agreement. No other representations or promises are binding. Any amendments must be in writing.

19. Survival

Provisions regarding liability, indemnification, intellectual property, and arbitration survive termination.

20. Assignment

We may assign these terms to successors. You may not assign your rights without written consent.

• Retirement Countdown: Target dates, milestones, theme preferences, uploaded backgrounds

Browser-Only Data (Never Sent to Servers)

• TSP Share Counts: Number of shares per fund (localStorage only)
• Session Data: Temporary data while using the site

Analytics and Usage Data

• Page views and feature usage
• Browser type and device information
• General location (country/state level)
• Interaction with tools and calculators
• Error logs and performance data

What We NEVER Collect or Store

• Calculator inputs or results (FERS, TSP, Leave calculators, etc.)
• Social Security Numbers
• TSP account numbers or passwords
• Bank account information
• Detailed financial records
• Health information
• Biometric data
• Actual retirement account balances

2. How We Use Your Information

• Authentication: Keep you logged in securely
• Service Delivery: Provide dashboard features across devices
• Communication: Send account, billing, and service notifications

3. Data Storage & Security

• Client-side encryption: Dashboard data encrypted in your browser

• At-rest encryption: All database storage encrypted

Storage Locations

• Firebase (Google Cloud): Encrypted account and dashboard data
• Your Browser: TSP share counts (localStorage)
• Stripe: Payment information (we never see card numbers)

Security Measures

• SSL/TLS for all data in transit
• Regular security updates and patches
• Limited admin access with audit logs
• Automatic logout after extended inactivity
• Password strength requirements
• Breach detection monitoring

IMPORTANT: No system is 100% secure. You use our service at your own risk.

4. Data Retention

• Account data: Retained while subscription active
• Payment records: 7 years per legal requirements
• Analytics data: Aggregated after 90 days
• Support communications: 3 years
• Encrypted dashboard data: Until you delete it

5. Your Privacy Rights

You Have the Right To:

Limitations:

• No data export capability currently available

7. Cookies and Tracking

We cannot control all tracking, especially from advertisers. Using our service means accepting this tracking.

• You are responsible for managing and cancelling subscriptions
• Forgotten subscription cancellations are not eligible for refunds

Export Controls

You may not use our service from embargoed countries or in violation of U.S. export laws.
